ชิงจังหวะปาดหน้า เคาะกฎหมายสำคัญออกมา ก่อนจะถึงการประชุมสถาผู้แทนราษฎร วันนี้ ซึ่งกำหนดเตรียมพิจารณา ร่างพระราชบัญญัติภาษีสรรพสามิต (ฉบับที่. ) พ. ศ. หรือ ร่าง พ. ร. บ. สุราก้าวหน้า ของนายเท่าพิภพ ลิ้มจิตรกร กับคณะเป็นผู้เสนอ หลังจากคณะกรรมาธิการพิจารณาเสร็จแล้ว ได้แบบฉิวเฉียด โดยที่ประชุมคณะรัฐมนตรี (ครม. ) เมื่อวันที่ 1 พฤศจิกายน 2565 มีมติเห็นชอบร่างกฎกระทรวงการผลิตสุรา พ. ศ. ตามที่กระทรวงการคลังเสนอ ก่อนจะมีการประกาศลงในราชกิจจานุเบกษา ทันทีในช่วงค่ำวันเดียวกัน คือ กฎกระทรวงการผลิตสุรา พ. ศ. 2565 โดยกฎกระทรวงนี้มีผลใช้บังคับตั้งแต่วันที่ 2 พฤศจิกายน 2565 เป็นต้นไป อ่านราชกิจจานุเบกษา : กฎกระทรวงการผลิตสุรา พ. ศ. 2565 สำหรับกฎกระทรวงการผลิตสุรา พ. ศ. 2565 ได้ปลดล็อกเงื่อนไขในการผลิตสุราแช่ชนิดเบียร์ หรือ “คราฟเบียร์เสรี” (craft beer) ด้วยการแก้ไขปรับปรุงกฎกระทรวงการอนุญาตผลิตสุราพ. ศ. 2560 โดยสาระสำคัญของ กฎกระทรวงการผลิตสุรา พ. ศ. 2565 ได้มีการยกเลิกการกำหนดจำนวนทุนจดทะเบียน และกำลังการผลิตขั้นต่ำทั้งหมด ซึ่งเงื่อนไขนี้เรียกว่า รัฐได้แก้ไขรายละเอียดจนเกือบจะเทียบเท่า ร่าง พ. ร. บ. สุราก้าวหน้า เลยทีเดียว คำถามต่อมาเมื่อกฎกระทรวงการผลิตสุรา พ. ศ. 2565 มีผลบังคับใช้แล้ว ผู้ที่ต้องการผลิต “คราฟเบียร์เสรี” ต้องปฏิบัติตามหลักเกณฑ์เงื่อนไขอะไร ถึงจะสามารถเป็นผู้ผลิตได้ ฐานเศรษฐกิจขอสรุปสาระสำคัญของกฎหมายได้ดังนี้ อ่านข่าวที่เกี่ยวข้อง ผู้ใดประสงค์จะผลิตสุราเพื่อการค้า ให้ยื่นคำขอรับใบอนุญาตพร้อมทั้งเอกสารหรือหลักฐานตามที่กำหนดในแบบคำขอต่ออธิบดี โดยผู้ยื่นคำขอรับใบอนุญาตผลิตสุราแช่เพื่อการค้า ต้องปฏิบัติตามหลักเกณฑ์และเงื่อนไข ดังต่อไปนี้ 1. กรณีสุราแช่ชนิดเบียร์ หรือ “คราฟเบียร์” และสุราแช่ชนิดอื่น ผู้ยื่นคำขอรับใบอนุญาตต้องเป็นนิติบุคคลที่จัดตั้งขึ้นตามกฎหมายไทยและต้องมีผู้ถือหุ้นสัญชาติไทยไม่น้อยกว่า 51% ของจำนวนหุ้นทั้งหมด 2. กรณีสุราแช่ที่ไม่ใช่สุราแช่ชนิดเบียร์ที่ผลิตจากโรงอุตสาหกรรมสุราขนาดเล็ก ผู้ยื่นคำขอรับใบอนุญาตต้อง มีลักษณะดังนี้ เป็นสหกรณ์หรือกลุ่มเกษตรกรที่จดทะเบียนตามกฎหมายว่าด้วยสหกรณ์ หรือ เป็นวิสาหกิจชุมชนตามกฎหมายว่าด้วยการส่งเสริมวิสาหกิจชุมชน หรือ เป็นองค์กรเกษตรกรที่ขึ้นทะเบียนตามกฎหมายว่าด้วยกองทุนฟื้นฟูและพัฒนาเกษตรกร หรือ เป็นนิติบุคคลประเภทห้างหุ้นส่วนสามัญจดทะเบียน ห้างหุ้นส่วนจำกัด หรือบริษัท จำกัดตามประมวลกฎหมายแพ่งและพาณิชย์ที่หุ้นส่วนหรือผู้ถือหุ้นทุกคนเป็นบุคคลธรรมดาซึ่งมีสัญชาติไทย 3.
